AI Product Terms
Last updated: October 2026
These AI Product Terms ("AI Terms") apply when you use any AI-assisted feature of VibeControls (the "Service"), provided by Burdenoff Consultancy Services Pvt Ltd ("we", "us", "our"). They form part of, and supplement, our Terms of Service. On AI-specific matters, these AI Terms prevail.
This is the standard AI Terms template for VibeControls. It is pending final legal review.
1. Scope
These AI Terms cover every feature of the Service that uses machine learning or a large language model to generate, suggest, summarise or classify content ("AI Features"), including features that call a third-party model provider you configure yourself.
2. How AI Features are provided
2.1 Where we operate the AI Feature, the underlying model provider acts as our subprocessor and is listed on our Subprocessors page.
2.2 Where you connect your own model provider (bring-your-own-key, "BYOK"), your use of that provider is also governed by your own agreement with it. We pass your inputs to the provider you selected and return its outputs to you; we are not responsible for that provider's behaviour, availability or output.
3. Your data and AI
3.1 Inputs you submit to an AI Feature (prompts, files, data and instructions) and the outputs it returns are your Customer Data and are governed by the Terms of Service, the Privacy Policy and the Data Processing Addendum.
3.2 We do not use your inputs or outputs to train, fine-tune or evaluate any generally available AI model, whether the AI Feature is operated by us or by a provider you configure, unless you explicitly opt in to a feature that says otherwise.
3.3 You must have the rights, lawful basis and any notices or consents needed to submit your inputs, including any personal data or third-party material. Keep personal data in prompts to a minimum, and do not submit special-category data.
4. Human review
4.1 AI outputs can be inaccurate, incomplete, biased or out of date. A competent person must review them before you rely on them, publish them or act on them.
4.2 You must keep a human in the loop for any decision that has a legal or similarly significant effect on an individual, such as decisions about hiring, credit, healthcare or access to essential services. You must not use AI Features to make such decisions on a solely automated basis.
4.3 AI outputs are not professional advice (legal, financial, medical or otherwise).
5. Agents and automations
Where an AI Feature can take actions (for example by running a tool, a workflow or an agent), it acts only within the permissions and configuration you grant it. You are responsible for configuring and supervising it, and for the actions it takes in your account.
6. Prohibited uses
In addition to our Acceptable Use Policy, you must not use AI Features to:
- break the law, infringe the rights of others, or produce discriminatory, harassing or deceptive content;
- carry out biometric identification, mass surveillance or social scoring of individuals;
- create deepfakes of identifiable people without their consent, or content designed to defraud or impersonate;
- try to extract system prompts or bypass safety controls, or build a competing service from the Service's AI behaviour.
7. Your obligations as a deployer
Where the law treats your use of an AI Feature as a high-risk AI system or an automated decision tool (for example under the EU AI Act or US state AI laws), you are the deployer and are responsible for any required impact or bias assessment, notices to affected individuals, and human-review, opt-out or explanation rights. On request, we will give you reasonable information about how the relevant AI Feature works.
8. Ownership of outputs
As between you and us, and subject to any model provider's terms, you own the outputs generated for you, to the extent the law allows ownership of AI-generated content. Outputs may be similar to outputs generated for other users. We make no warranty that outputs do not infringe third-party rights.
9. Disclaimer
AI Features are provided "as is". To the extent the law allows, we make no warranty about the accuracy, reliability, fairness or fitness for purpose of AI outputs. The limitations of liability in the Terms of Service apply to AI Features.
10. Suspension
We may suspend or restrict AI Features for an account where we reasonably suspect abuse, unlawful automated decision-making or a breach of the Acceptable Use Policy, and we will notify you.
11. Changes
We may update these AI Terms. We will give at least 30 days' notice of material changes, such as a new model provider or a change to how your data is used.
